Terms and Conditions for the Education UK website

Please read the user terms below carefully. By accessing www.educationuk.org or any other domain registered as Education UK (see end for list) you are agreeing to the terms that appear below, whether or not you register an account.
These terms of use and our Privacy Policy as amended by us from time to time ("terms") govern your use of our website – www.educationuk.org – and any and all services (including online video broadcast and commenting) that we make available on or through our website. By using our website, you are agreeing to these terms, whether you are just browsing or whether you are a registered user (i.e. you have completed and submitted the registration form to create a user account). Please stop using our website if you do not agree to these terms.
We may revise these terms at any time at our sole discretion. Please check back regularly for updates: you can easily determine whether changes have been made by confirming the version date at the top of these terms. Your continued use of our website means that you agree to these terms, as revised.

Registration/Password
2.1 You do not need to give us any information to browse our website, but in certain circumstances, we do ask you to register with information about yourself so you will receive a better experience or before you can interact with specific functions. Registration on our website is free.
2.2 To register, you must either:
(a) confirm that you are over 16 years of age; or
(b) if you are less than 16 years of age, please see Section 4, below.
2.3 You agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate, up to date and complete. We reserve the right to terminate your account and access to our website if we learn that you have provided false or misleading information.
2.4 When you register to use our website, you will be asked to create a username and password. You agree not to divulge your password to any other person. You are responsible for maintaining the confidentiality of your password, and will be fully responsible for all liabilities arising in connection with your password's use (or misuse), whether such use or misuse is with or without your knowledge or approval. If you suspect that someone else knows of or is using your password, you must notify us immediately by emailing us.
2.5 If you forget your password, please follow the instructions in the My Account area to reset your password.
2.6 We have the absolute discretion to cancel your username/password at any time if we suspect it is being used by an unauthorised person.
Your use of our website
Course Provider Content
3.1 For the purposes of these terms, “Course Provider Content” refers to all data, text, logos, artwork, software, documents, images, photographs and other materials presented on the Education UK website by a specific educational provider (such as a university, school, college, organisation, company or individual offering courses in the UK) about a course or programme or the institution itself. Course Provider Content is provided by and remains the property of the university, school, college, organisation, company or individual offering courses that are publicised on the Site.
3.2 We want the site to be as comprehensive as possible, and we make every effort to ensure that the information that appears on the site is correct and up to date. However, Education UK cannot accept any responsibility for the quality or accuracy of the Course Provider Content or the information posted about them. This means that when it comes to applying for a course or enrolling on a course, the normal rules of "buyer beware" apply. CHECK CAREFULLY before you apply for a course that you are happy with the both the contents of the course and the quality of the Course Provider. If your application for a course is accepted, you will be entering into a contract directly with a Course Provider.
General use
3.3 You may retrieve and display site content on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form (but not on any server or other storage device connected to a network) for your personal, non-commercial use.
3.4 Except as expressly set out above, you may not reproduce, modify or in any way commercially exploit any of the content on this site. In particular, you may not do any of the following without prior written permission from the British Council:
- redistribute any of the content (including by using it as part of any library, archive or similar service);
- remove the copyright or trade mark notice from any copies of content made under these Terms;
- create a database in electronic or structured manual form by systematically downloading and storing all or any of the site content.
3.5 You acknowledge that "Education UK" and "The British Council" are trade marks and that you may not use them without written permission from the British Council.
3.6 You agree that you will not use our website:
(a) for commercial purposes or to obtain financial gain without our prior written consent;
(b) to send chain letters, junk mail, 'spam', business or bulk communications of any kind;
(c) to advertise a company, product or service of any educational establishment except under the terms of a written advertiser agreement that we have entered into with you;
(d) in a way, that might reasonably be expected to cause another person's computer systems and/or their communications network to be interrupted, damaged or rendered less efficient;
(e) to obtain personal information from other users under the age of 16 or from anyone if such information is gathered deceptively or in a non-transparent way;
(f) to obtain passwords or personal identifying information for commercial or unlawful purposes from other users;
(g) to attempt to impersonate another user; or
(h) to harass, threaten or intimidate any user.
3.7 You will be for responsible for logging out from your registered account at the end of each session on our website.
3.8 If you are a user, you agree not to obtain unauthorised access to areas of our website reserved for registered users.
3.9 If you are aware of anything on our website which appears to infringe these terms, you agree to contact us immediately.
Under 16 years of age
4.1 If you are under 16 years of age and want to register on our website, you must obtain a parent or guardian's permission beforehand. You may also discuss these terms with them before obtaining their permission.
4.2 If you are a registered user under 16 years old, you will need to obtain a parent or guardian's permission before taking part in any online discussions. You should never reveal personal information about yourself, such as your address, telephone number and school.
Content posted (User Generated Content)
5.1 For the purposes of these terms, "User Generated Content” or “UGC" refers to all data, text, logos, artwork, software, documents, images, photographs and other materials you may upload to our website including information about yourself, messages posted or comments about certain courses or course providers.
5.2 Education UK reserves the right to moderate submitted UGC in order to maintain editorial standards and user experience. In this way, Education UK will not accept material that:
(a) infringes any third party's Intellectual Property Rights ("Intellectual Property Rights" means registered and / or unregistered copyright, database rights, trade marks, design rights and other intellectual and proprietary rights of whatever nature, and all applications for such rights, anywhere in the world);
(b) breaches any applicable law;
(c) is unlawful, false, unreliable or misleading, obscene, defamatory, libellous, threatening, pornographic, harassing, hateful, profane, sexually or racially or ethnically offensive, encourages conduct that would be considered a criminal offence, give rise to civil liability, or is otherwise inappropriate in our opinion.
(d) disrupts the communications of the online community on our website.
5.3 By uploading any UGC on the Education UK website you agree to
(a) grant to Education UK a royalty-free, perpetual, irrevocable, non-exclusive right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and communicate to the public such UGC; and
(b) you authorise us to adapt such UGC and you agree to waive your moral rights to object to any derogatory treatment, or to be identified as the author, of the material in question.
5.4 In order that Education UK can use your UGC, you confirm that your contribution is your own original work and that you have the right to give Education UK permission to use it for the purposes specified above, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent / guardian if they are under 16;
5.5 Education UK may share your contribution with trusted third parties. You retain copyright of your UGC. Your permission granted to Education UK to use your contribution is not exclusive, so you can continue to use the material in any way including allowing others to use it.
5.6 Education UK may need to contact you for further information regarding your submitted UGC. By uploading your UGC on to www.educationuk.org you grant Education UK permission to contact you. For further details of the methods in which we may contact you, please refer to our Privacy policy.
5.7 None of the views expressed in any UGC are the views of the British Council - we are just providing a platform. You acknowledge that all content is the responsibility of the person who posted, emailed or otherwise provided the content to our website. You acknowledge that by using the website, you may be exposed to content that is offensive, indecent or objectionable. We are not responsible in any way for any content - and if you post, email, upload or otherwise provide content, you are entirely responsible for it. However, we operate a "take down and notice" procedure. If you believe that any content contravenes the spirit or letter of these terms, please notify us immediately by contacting educationuk.website@britishcouncil.org. We will investigate each matter notified to us and will act in our sole discretion.
5.9 If you post content which is found to be in breach of these terms, we reserve the right to deactivate your username and password to prevent you from further access to our website as a registered user.
Intellectual Property Rights
6.1 You agree that our website and all content contained in it are protected by Intellectual Property Rights that either belong to or are licensed to us.
6.2 You acquire no proprietary interest in our website or content provided by us or others and may not use them in any way except as expressly permitted by these terms.
6.3 You may view, print, download or temporarily store such content for your personal, non-commercial reference without alteration, addition or deletion. 3.2 We want the site to be as comprehensive as possible, and we make every effort to ensure that the information that appears on the site is correct and up to date. However, Education UK cannot accept any responsibility for the quality or accuracy of the Course Provider Content or the information posted about them. This means that when it comes to applying for a course or enrolling on a course, the normal rules of "buyer beware" apply. CHECK CAREFULLY before you apply for a course that you are happy with the both the contents of the course and the quality of the Course Provider. If your application for a course is accepted, you will be entering into a contract directly with a Course Provider.
General use

(b) breaches any applicable law;
(c) is unlawful, false, unreliable or misleading, obscene, defamatory, libellous, threatening, pornographic, harassing, hateful, profane, sexually or racially or ethnically offensive, encourages conduct that would be considered a criminal offence, give rise to civil liability, or is otherwise inappropriate in our opinion.
(d) disrupts the communications of the online community on our website.
5.3 By uploading any UGC on the Education UK website you agree to

5.7 None of the views expressed in any UGC are the views of the British Council - we are just providing a platform. You acknowledge that all content is the responsibility of the person who posted, emailed or otherwise provided the content to our website.
